TERMS & CONDITIONS
AGENT:
Agents warrant, undertake, authorise and agree that:-
1. They agree to the Terms and Conditions of The Company. This will be indicated by their registration with The Company and payment of a Connection Fee of $550 (GST Inc).
2. There is no limit to the number of properties that the Agent may list on the payment of an additional Submission Fee of $220 (GST Inc) for each Property. The Agent agrees to make this payment to The Company prior to uploading the Property details on The System.
3. They are registered and licenced in accordance with the Relevant Legislation of their Local Jurisdiction.
4. They hold professional indemnity insurance and indemnify The Company, their Directors, Shareholders and Employees against any liability for the action of the Agent or agent’s employees.
5. They will upload the draft Contract of Sale and all property details including search results onto The System. They will update these details as required.
6. They will be responsible for ensuring the information provided by the Seller is complete and accurate within reason.
7. They will verify the Seller’s identification by viewing acceptable documentation and checking the Seller against the Certificate of Title.
8. They will verify the identification of the Buyer where practical and notify The Company of any discrepancies.
9. They will obtain relevant title and body corporation searches. They will obtain other necessary searches including but not limited to pest and building reports when required, company and trust searches and provide tenant details on behalf of the Seller.
10. They will not bid on behalf of the Seller nor procure anyone else to do so.
11. They will obtain the necessary listing authorities by complying with Relevant Legislation in the Local Jurisdiction and completing all relevant forms including but not limited to ensuring the Seller has not listed with another agency. They will satisfy all other Agent requirements under the Relevant Legislation of the Local Jurisdiction.
12. They will have the Seller acknowledge and agree to the Terms and Conditions on 2bid2.com Ltd by attaching a signed copy of the Seller’s Terms and Conditions to the relevant listing agreement.
13. The agent agrees that all marketing material must contain the title Buy On-Line and include a starting time, closing time and date but must also state that the end time may vary. Agents also have the option of using the 2bid2 logo on signboards, brochures, newspaper and internet advertising.
14. These terms and conditions must be read in conjunction with the general terms and conditions.
15. Should a property sell within the pre-determined time frame then a success fee of $220 (GST Inc) will be paid to The Company by the Agent.
